In the event Lessee is unable to obtain appe rmits and permiasiona nccessary to install~ operate and maintain on the leased premises the necessary buildings and equipment for conducting ita busineas as herein pr~vided~ or if at any t~me hereafter Lessee is prevented by operation of lay~ irom using said station and pnmisea ior the purposes aforesaid. then and in any oi said eventa Lessee may. at ita option~ ~csu~cel thie ~ lease and be relieved oi any iurther liability hereunder. At any time. or from time to time. or on the termination of this lease by lapse of time or otherwise, Leasee may. at its option and at ita own expense. remove irnm the demised premises any part of or all the improvements and equipment of whatsoever nature heretofore or hereafter placed or owned by it on the demised premises. whether affixed to the premises or located on or under the eame. or not; and after auch removal shall reatore the surface oi the ground to its uniform level and even condition~ free from all excava- tious and debris. 12. PURCHASE OPTION : Lessor hereby givea and granta unto Lessee?th~ rights and optiona to pur- chase the herein described property and improvements thereon for the sum of.. - ~ . . -......:..Dollara. This option may be exereised by giving Lessor thirty (30) days' notice in writing at any time during the original term and all extenaiona of this lease. Lessor agrees to convey the property by War- ranty Deed, clear of all liena and furniah title inaurance in the amount of the purchase price. If at any time during the primary term any extension period or any tenancy after either, Lessor receives from a ready, willing and able purchaser. an acceptable bona fide offer to purchase~ or makes a bona fide offer to sell to such purchaser. the premises or any part thet~- of or any pro~erty which includes all or any part of the premisea : Les.sor ahall give Lessee notice, specifying the name and addresa of the purchaser and the price and ter~ms of the offer, accompanied by Lessor'a affida- vit that the proposed sale is in good faith. I.essee shall thereupon have the prior option to purchase the premisea or the part thereof or the entire property covered by such offer, at the price and on the tercas of the offer but subject to the tertns provided in article 12, which option Lesaee may eacercise by giving I.essor notice within thirty (30) days after Les.s~e's receipt of Lessor's notice of the offer. 14. r111 notices given under this instrument shall be in writing, and may be given either in the statutory method, if any~ in the State where the premises are situated~ or by depositing the not~ce in the United States registered or certified mail. postage prepaid, enclosed in an envelope addressed to the party to be noti6ed, at such party's address as shown in this instrument. or at any known address of any Lessor, if there be mare ~ than one; and the day upon which such notice is so mailed shall be treated as the date of service. Such notice ~ ~ also may be served on Lessor in person or on an officer or manager of Lessee. If there be more than one Lessor, notice to any one of them shall constitute notice to all, and notice from any one of them shall constitute notice from all. 16. TNIS AGREEMENT shall be binding upon and inure to the benefit of Lessor and Leasee and as well the grantees, heirs. executors, administrators, successors and assigna of Lessor, and the succeasors and aseigns of Lessee. Lessee shall have the right to assign this lease or sublet the premises or any part thereof. or allow third parties to occupy and use the same. This agreement constitutes a merger of all proposals. negotiationa and representations with reference to the subject matter and provisions hereof. and may be altered. amended or modified only in writing signed by Lessor and a representative of Lessee authorized to sign this agreement.
