This cause havinq come on for hearing before the Court
on plaintiff's r.~otion for suaunary judgment, and the Court
having considered the proofs submitted arid arqument of
counsel for the parties, and the plaintiff having conceded
that it is entitled to recover interest against the defen-
dant, BRIAN K. McCARTY, III, at a rate of 10 per cent per
annum as provided in Sec. 687.11 Fla. Stat. and, the Court
being fully advised in the premises, it is thereupon
ORDERED AND ADJUDGED that plaintiff's motian for summary
