DEFINITIONS
Section l. The followinq words when used in this
Declaration or any Supplemental Declara~iua (unless the context shall
prohibit) ahall have the followinq meaninqs:
(a) "Association" shall mean and refer to THE VILLAS OF
SANDPIPER BAY PROPERTY OWNERS ASSOCIATION, INC.
(b) "The Properties" QhAll mean and refer to all such
existing properties, and additions ther~~a, as are subject to this
Declaration or any Supplemental Declaration under the provisions of
Article II hereof.
(c) "Common Properties" ahall mean and refpr to those
areas of land shown on any recorded subdivision plat of The Properties
and intended to be devoted to the connnon use and enjoyment of the
owners of The Properties. -
(d) "Living Unit" shall mean and refer to any portion of
a building situated upon The Properties designed and intended for use
and occupancy as a residence by a single family.
(~j "Owner" shall mean and refer to the record owner,
whether one or more persons or entitites, of the fee simple title to
any Lot or Living Unit, but, notwithstandinq-any applicable theory
concerning a mortqage encumberinq any Lot or Living Unit, shall not
mean or refer to the mortgagee unless and until such mortgagee hag
' acquired title pursuant to foreclosure or any proceedinq in lieu of
t foreclosure.
f (f) "Member" shall mean and refer to all those Owners

~ who are members of the Association as provided in Article III, Section

~ (q) "Lot" shall mean and refer to any plot of land shown ~
~ upon any recorded subdivision map of The Properties with the exception
~ of Comanon Properties as heretofore defined.
