HomeMy WebLinkAbout2005 of the Members hereunder shall be fully restored= and (b) the riqht of the Aesociation to t~ke such steps as are reasonably necessary to protect the above-described properties aqainst #oreclosures and (c) the riqht of the Association,. as provided in ita Articles and Sylaws,` to auspend the enjoyment rights of any Member - for any period during which any asseasment remains unpaid, and for any period not to exceed thirty (30) days for any infraction of ita published rules and requlations; and (d) the right of the Association to charge reasonable admission and other fees for the use of the Conmion Properties; and - ' (e) the riqht of individual Members to the exclusive use of parking spaces as provided in Section 5 of this Arti~l~ and (f) the drainage and temporary retention o£ storm water run-off uses of the Common Properties referred to in Section 3 of this Article. ~ (q) t~e riqh~ the Association to dedicate or transfer all or any part of the Common Properties to any public - aqency, authority, or utility for such purposes and subject to such con3ition~ a~ may be agreed to by the Members, provided that no such dedication or transfer or determination as to the purposes or as to the conditions thereof, shall be effective unless an instrument signed by Members entitled to cast two-thirds (2/3}-of the votes of each class membership has been~recorded,'agreeing to such dedication, trans- i ~ fer, purpose or condition, and unless written notice of the proposed ~ ~ agreement and action thereuhder is sent to~every Member at least ~ ninety (90) days in advance of any action taken. ~ Section 5. Parking Rights. The Association may designate ~ ~ and maintain upon the Common Properties certain parking spaces for the exclusive use of the Members, their families and guests. The s ~ use of any such parking space by any other person may be enjoined by € R g the Association or the Members entitled thereto. ~ ; Section 6. Utility Easements. There is reserved unto the F a ~ Developer until January 1,1978 the right to gxant easements for the ~ installation and maintenance of public utilities on the Common . ~ ~ Properties in addition to those already reserved.
