T~S MATTSR having come on to be heard on Motions of the
Defendant, LUCILLS V. QUSTA, INC., to dismiss and on the Order to Show Cause,
and after hearing argument of couasel and being fully advised in the presnises,
it is hereby -
ORDBRED as follows: ~
1. The M~tion to dismiss Count I of the Second Amended
Complaint be and it is hereby denied.
2. The Motion to dismiss Coiutt II of the Second Amended
Coa~plaint be and it is hereby granted; however, by agreement of counsel for
, the parties hereto, should the Plaintiff fail to perfect its mechanic's lien

j ~mder Count I of said Second Amended Complaint and should Plaintiff sho~ facts

~ entitling it to an equitable lien, the Court may at that time grant such an
~ equitable lien. -

€ 3. The Motion to dismiss Count III of the Second Amended
Complaint be and it is hereby deaied.
4. Plaintiff's oral motion to further amend its Second
Amen~d Complaint by adding the words "and Exhibit I thereof" at the end of
paragraph 20 of Count III of its Second Amended Complaint be and it is hereby
granted, and such amendment is hereby interlined in the original of the
Second Amended Complaint.

hereby continued to a later date to be set.
