AGREEMENT ~

WHEREAS, Central & Southern Florida Flood Control -
District, a public corporation of the State of Flor3da, party
of the first part, is the owr~er of certain real property _
situate in St. Lucie County, Florida; acquired by deed from
Fort Pierce Port and Tenainal Company dated June 26, 1960, and
recorded in Deed Book 260, page 355. public records of St.
Lucie County, FZorida; and
WHEREAS, the aforesaid property is utilized by party
of the first part for operation and maintenance of its canal
C-25; and ,
WHEREAS, Arthur P. Byal and Patrick B. Lally, and Taylor
Creek I~iarina, Inc., hereinafter referred to collectively
as party of the second part, are the owners of certain por-
tions of the.real property lying south of and contiguous
to the aforesaid property owned by party of the first part,
the lands owned by party of the second part being more parti-
cularly described in that certain deed from Robert V. Rasmussen
to Arthur P. Byal and Patrick B. Lally dated March 20, 1973,
and recorded in O. R. Book 213, page 9G8; and in that certain
deed from Robert V. Rasmussen to Taylor Creek Marina, Inc. ~
. dated March 20, 1973 and recorded in O. R. Book 213, page
966, public recards of St. Lucie County; and

WHEREAS, party of the second part wishes to be assured '

of 1ega1 access from their property to the waters of Taylor ~
Creek (C-25) and of the right to erect a deep water bulkhead
along their property line;
NOW THEREFORE, in consideration of Ten Dollars ($10.00)
and other good and valuable considerations, it is agreed
as follows:
