ORDER ON PETITION FOR MODIFICATION
AND
ORDER OF CONTEMPT
This matter coming on to be heard by the undersigned, and the
Court having heard the evidence of the parties, it is thereuvon:
~ ORDERED AND ADJUDGED as tollows:
1. That the Petition for Reduction of Child Support Payments
be, and the same is hereby denied.
2. That the Court finds that RICHARD F. SMITH, III, Husband,
is in arrears in the amount of $479.50 on his back child support
payments, and orders that $30.00 be paid to DORIS H. SMITH HAINES,
instanter, leaving a balance due of ~449.50. This balance is to
be paid by paying $20.00 on October 10, 1975, and $50.00 on the
lOth day of each-month thereafter until the whole arrearage shall
be paid. The Husband is in Contempt of the original Order of Court
and if he fails to m3~e the gayments on said arrearage as required
herein, he shall be imprisoned in the St. Lucie County Jail for
ten da~s. An affidavit by the former Wife as to deficiency shall
cause the appropriate proceeding to issue to have the said RICHARD F.
SMITH, III taken into custody and~to serve the ten day sentence
herein imposeci.
3. The Court hereby defines reasonable visitation rights for
the former Husband with his child as follows, to-wit: The Husband
shall have custody of said child commencing on the weekend of
September 26, 1975, commencing at 5:Q0 p.m. on Friday and ending at
5:00 p.m. on Sunday, September 28, 1975. Thereafter the Husband
shall have the right to have said child visit with him on the thir3
weekend of each month commencing at 5:00 p.m. on Friday and ending
at 5:00 p.m. on Sunday. In addition thereto the former Husband
shall have ~he right to have said chiZd visit with him for one week
