This cause coming on to be heard on September 24, 1975, upon
•Motion of the Petitioner, PATRICIA STOREY ANDERSON, and the ~
Petitioner being represented by counsel, Douglas P. Lawless, and ~

the Respondent being present ar~d represented by counsel, Edgar A. ;
` Brown, and the Court having heard testimony of the parties, argu- !

ment of counsel and otherwise being advised in the premises, the !
Court finds as follows: ~

~ 1. That the Wife has not overcome the presumption of correct-{

~ness of the Order entered in this matter on October 2, 1979, modi-~
i
; fying the child support payments and setting them at the rate of !
~~Thirty Dollars ($30.00) semi-monthly. ~

: 2. That the Husband admits failing to pay the arrearages as ~
' ordered by the Court on October 2, 1974, and admits being in arrea~s
~ !
in the amourit of Two Thousand Two Hundred Thirty-nine and 50/100 l
~ i
; Dollars ($2,239.50). i

~ 3. That the Ausband also acknowledges failing to pay the Wife
~ i
j ~ lnree Hundred Fifty Dollars ($350.OOj as her share in certain ~
~ . 1
~ ~ -'.property sold prior to the dissolution of,the couple's marriage, ;
~ ~
~ : and of having failed to pay his share ($21.50) of costs in said ;

~ ~action. ' ;

~ 4. That the Husband is employed and by his own admission ~

~ able to pay the.Wife the arrearages owed at the rate of Twenty-five.~

! Dollars ($25.00) semi-monthly. {

~ 5. That~the provisions of the final judgment and settlement ~
~ '
~ agreement concerning the Husband's obligation to make house payment~s
is ambiguous, and the Court finds that the 8usband is not in arrear~

~ on said payments, and owes no such payments. t
