CROSSCLAIM OF INTERVENORS
This cause came on for final hearing before the Court
on September 25, 1975, and the Court having heard and received
testimony and evidence from the intervenors, Nicholas U. Wagner
and Helen W. Wagner, his wife, and from the crossdefendant,
~t Loretta E. Wagner, and having heard vigorous arguments of
~ counsel and being fully advised in the premises, it is hereby
~ ORDERED AND ADJUDGED as follows:
1. The promissory note made jointly and severally by
Joseph A. Wagner and Loretta E. Wagner evidencing an indebtedness
to the intervenors in the original principal sum of $15,000 does
not contain an acceleration clause.
2. Payment of the installments due each and every month
according to the terms of said promissory note is secured by a
purchase money equitable lien in favor of the intervenors,
Nicholas U. Wagner and Helen W. Wagner, his wife, encumbering ~

the real property which is the subject matter of this suit,
to wit: ~
