and that no written agreements except such leases have

with tena~t's occupancy of ~he premises; and that all work
to be nrovided to be done or equipment furnished under any -
of said leases has been done or furnished. That the afore-
said leases are in full force and effect and~there has
been no occurrence under any of them which with the giving
of notice or passaqe of time would constitute a default.
(D) That the pro forma financial statement hereto
arinexed as Schedule "C" accurately reflects the present ex-
penses of operation of the Project on an annualized basis. -
(E) That there are no actions, suits or pro- ~
ceedings pending before any court, government instru.~entality, ;

agency ar ha3y or any arbitration tribunal materi~lly af-
fectinq the Project in an adverse fashion. ~
(F) That there has been no declaration of
default by the holder of any mortgage affecting the Project -
or the fil~ing o~ any mechanics' ~liens against the ~Project
and/or the filing of a lis pendens against the Project
