RIGHT TO PURCHASl3

IN RE: All of Lots 9 and 10 of P. P. COBB'S ADDITION TO FORT
PIERCE, as recorded in Plat Book l, paqe 9, of the
public recorda of St. Lucie County, Florida, lyinq East
of Depot Drive and the 3 foot strip of land in Block 2,
of W. T. JONES SUBDIVISION, Plat Book 2, page 5, which
adjoins the above mentioned Lots 9 and 10 on the South.
WHEREAS, NORRIS J. COOPER, hereinafter called "COOPER",
contracted to sell BITTAN, INC., a Florida corporation, hereinafter
called "BITTAN", Lot 11 of P. P. COBB'S ADDITION TO FORT PIERCE,
. and,
WHEREAS, a survey of said Lot 11 has revealed the encroach-
ments of several buildings of Cooper over onto Lot 11, and
WHEREAS, both parties recognize such encroachments exist
at this time and do not wish to have any of the buildings of Cooper
which encroach on said Lot 11 physically removed trom the bounda-
ries of Lot 11 until the owner of the buildings which encroach
voluntarily desires to raze the buildings which presently encroach,
and,
. WHERFAS, both parties hereto feel the best solution to such
encroachments is to give Bittan the first right to purchase all of
the property now owned or hereafter acquired by Cooper between the

~ West line of said Lot 11 and Depot Drive, as well as the 3 foot

~ strip in W. T. JONES.SUBDIVISION, which adjoins Lots 9 and 10 of
F. P. COBB'S ADDZTION on the South,

c~ NOW, THEREFORE, for and in consideration of Bittan ~losing

! ~ d~ the purchase of Lot 11 at this time, with the building encroachments

~ L~~ existing over the West line of said Lo~ 11, Cooper hereby gives
~ Bittan the right of first refusal on the purchase of all of Cooper's

~ presently owned or hereafter acquired property in Lots 9 and 10 of

~ P. P. COBB'S ADDITION, together with the aforementioned 3 foot strip .
