HomeMy WebLinkAbout0120 itself and its designated agents, appointees and assigns, until such time as provided in the Certificate of Incorporatfon of the Condominium Association, the exclusive management, operation and control of the Condominium Association, and the responsibility for performing all of the Condominium Association•s obliqations and functions, which the Developer may accomplish directly, or indirectly, by vir.tue of Developer's right to appoint directors as hereinbefore provided and as provided in the Certificate of incorporation. Therefore, any provisions of these By-Laws, and ~the Certificate of Incorporation of the Condominium Association, and in the Declarat~on of Condominium of Oceana Oceanfront Condo- minium, which are in conflict with the provisions herein for the benef it of the Developer, shall be superseded_by.such provision or provisions for the benefit of the Developer. So long as the Developer vwns title to any of the apartments to be governed by this Condominium Association, and offers them for sale in the i ` . ordinary course of business, the follawing actions may not be f taken without approval in writing boy the Developer: (a) Assessment of the Developer as an awner for capital improvements. i ~ (b) Any action taken by the Condominium Associa- ~ tion that would be detrimental to the sales of apartments by the ? ' i - ~ I ARTICLE XI. ~ f ; Amendments Ii Prior t~o the relinqui.shment of control of the Board of Directors by the Developer, these By-Laws may be amended by a majority vote of the Board of Directors. Subsequent to such time, amendments to these By-Laws may be made by~a three-fourths v~ote of inembers of tY~e Condominium Association.
