Association and any rules and regulations promulgated by said
Recreation Association. ,
6. Force Majeure. Recreation Association or
Condominium Association shall not be held liable for any failure
or amission in the perforn~ance of any stipulation or provision of
the Membership Agreement if such performance is prevented by any
act of God, Federal, State or Municipal order, legislation or
regulation, embargo, fires, floods, strikes, wars or shortage or .
failure of shipping facilities.
7. Non-Waiver. Failure of the Recreation Association
to insist upon the strict performance of any of the covenants,
conditions and agreements of this Membership Agreement in any one or
more instances, shall not be construed as a waiver or relinquishment
in the future of any such covenants-, conditions and agreements.
8. Covenants to Run With Land. Al1 covenants, condi-
tions, provisions and agreements contained in this Membership Agree-
ment are to run with the land and shall be binding upon and inure
to the benefit of the Recreation Association, its successors and
assigns, and the Condominium Association, its successors and assigns,
! and all persons claua~ng by, through or under the Recreation Asso-

~ ciation and the Condominium Association.

~ 9. Time of the Essence. It is understood and agreed
betw~een the parties hereto that time is of the essence of this

~ 10. Notices. All notices required by law or by this

~ Membership Agreement given by one party to the other shall be in
~ writing and shall be served by personal delivery or certified or
