HomeMy WebLinkAbout1312 ~ i _ ~ : REC~IPT, ACK:~OWLEDGtiCNT, ASSUt1PTI0:7 AND ACCEPTA~IC~ I3Y PURCI!AS~R Purchaser, by aceeptance and execution of this Receipt, acknowledges that this purchase of a condominium unit at OCEAN VILL~IG~ OF ~IUTCHINSON ISLAtdD is subject in every respect to the Oeclaration o£ Condominium as to the condominium in which his unit is located and ~xhibits attached thereto, incZudinq but not limited to (whether the same are attached to the Declarati.on or referred to therein), the By-Laws of the Assoeiation, Articles of Incorporation, the Rules and Regulations, copy of projected operating budget, copy of sales brochure and floor plan of apartment purchased b~ Purchaser, and all Amendments to the aforesaid Declaration and Exhibits and the Articles of Incorporation, By-Laws and Declaration of Covenants and Restrictions of the Property Owners' Association; and Purchaser further acknowledges receipt of and reading and examination of said Declaration, its Eshibits, and,budget, sa2es brochure and floor plan, and acknowledges that each and every provision of the foreqoing is essential to the successful operation and management of the Condo- minium property and is in the best interests and for the benefit of aZl the owners therein. Purchaser and all owners of parcels in the aforedescribed Condominium covenant and agree to abide by each and every provision of said Declaration of Condominium and Exhibits ~ attached thereto. Purchaser hereby ratifies and confirms and approves all of the terms and provisions of said Declaration of Condominium and Exhibits attached thereto, and agrees that the assessment under • the Property Owners' Association documents referred to above and the provisions thereof are reasonable, fair and equitable, and said Pur- chaser acknowledges and confirms that the Declaration of Covenants -and Restrictions of the Property Owriers' Association has encumbered and irapressed a lien upon the Condominium parcel being conveyed to Purchaser, as security for his obligations under the said Declara- tion of Covenants and Restrictions of the Property Owners' Associa- tion and said Purchaser assumes the obligations as to the Property Owners' Association as to his condominium parcel. Purchaser confinas that all warranties, representations and inducements if any, are as contained in the aforesaid Declaration of Condominium and Exhibits attached thereto, and the common expenses and the sums due under the Property Owners' Association and other charqes are estimated only. No warranty or quaranty is made or intended, nor may one be relied except where the same is specifically warranted or guaranteed in said Declaration of Condominium and the Exhibits attached thereto.
