HomeMy WebLinkAbout2167 14 and every term and condition contained in Article XVII of the Mor~ gage, as heretofore am~nded, shaU apply to and form part of this Thirty- second Supplemental Indentur~ with the same forc~e and effect as if the same wen herein set forth in full with such omissions, variation~ and ins~rtions, if any, as may be apprnpriate to make the same ooniorm to ~ t}~e.provisions of this Tlurty-second Supplemental Indenture. SEC~riox 6. Whenever in this Thirty-second Supplemental Indenture either of the parties hereto is named or referred to, this shaU, subject to the provisions of Articles XVI and XVII of the Mortgage, as hereto- fore amended, be deemed to include the successors and asaigna of such party, and all the covenants and agreementa in thie Thirty-second Sup- pleraental Indenture contained by or on behalf of the Company, or by or ~ on behalf of the Trustees, or either of them, ahall, subject as aforesaid, bind and inure to the respective bene8ts of the respective suc~easora and ~ assigns of such parties, whether so expressed or no~ ' • SECrtox 7. Nothing in this Thirty-second Supplemental Indenture, expres,ged or implied, is intended, or shall be oonstrued, to confer upon, j or to give to, any person, firm or carporation, other than the parties i hereto and the holders of the bonds and coupons Outstanding under the ; Mortgage, any right, remedy or claim ander or by reason of this Thirty- second Supplemental Indenture or any oovenant, oondition, stipulation, ~ prnmise or agreement hereof, and all the covenants, conditions, stipula- ~ tions, promises and agreements in this Thirty-second Supplemental In- ~ denture contained by or on behalf of the Company shall be for the sole t and exclusive benefit of the parties hereto, and of the holders of the ~ bonda and coupons Outstanding under the Mortgag~ ~ S~ort 8.
