O R D E R
THIS CAUSE coming on to be heard upon the Motion for Dis-
bursal of Funds, filed herein by Plaintiff, and the Response to said
Motion filed herein by Defendant, and the Court further hearing argu-
ment of counsel for SOL RIZZUTTO on his motion for distribution, and
the Court being fully advised, it is,
ORDERED AND ADJUDGED that ROGER POITRAS, Clerk of the Cir-
; .
' cuit Court shall make distribution at 9:00 o'clock A.M. on Friday,
November 14, 1975, from the proceeds in the Registry of the Court, as
follows:
(A) The Clerk shall issue a check in the sum of
$263.96 to Rinker Materials.
(e) The Cl.erk shall issue a check in the sum of
$573.27 to Krause & Crane.
(C) The Clerk shall deduct the Clerk's registry
fee from said Registry funds in the swn of
$62.37.
~ {D} The Clerk shall issue a check in the sum of
$1,000.00 to Gerald S. James, Attorney for
Plaintiff, for attarney fees, together with
f costs advanced by said attorney in the sum
I of $10.87 for publication, PROVIDED that in
~ the event supersedeas bond of $1,000.00 is
i posted and filed on or before 9:00 o'clock
'i A.M., November 14, 1975, pursuant to notice
of appeal and upon the posting of said bond
in favor of Plaintiff, the Defendant and/or -
Defendant's sureties, then in that event, the
Clerk shall retain the $1,000.00 attorney's
fee in the Registry of the Court pending ap-
peal and subsequent order of this Court.
