ORDER DENYING MOTION TO DISMISS This cause havinq come on before the Court on the motion to dism.iss of defendant, HQTCHINSON ISLAND LIMITED PARTNERSHIP, and argument of courisel having been received, the court finds as follaws: ~ 1. The Order of the Supreme Court of the State of _ ~ Florida adoptinq the Florida Rules of Civil Procedure pro- vides that said rules shall supersede all conflicting rules and statutes. In re: Florida Rules of Civil Procedure 1967 ~ ~ Revision, 187 So. 2d 598 (Fla. 1966). ~ ` 2. Section 713.22(2) of the Florida Statutes provides ~ i in part: ~ ~ ~ "The lien of any lienor upon which notice is s~rved E and who fails to institute a suit to foreclose his ~ lien within sixty days after service of such notice : shall be extinguished automatically. The clerk ~ shall mail a copy of the notice of contest to the lien claimant at the address shown in the claim ~ of lien or most recent amendment thereto and shall certify to such service on the face of such notice ~ and record the notice. Service shall be deemed complete upon mailinq." ~ 4 ; 3.
