TRAFFIC INFRACTIONS - F. S. 318

Any person cited with the commission of a traffic infraction ma~y, where no hearing
is required or heard and the offender admits the infraction by posting, then forfeiting
a cash bond or paying the penalty to the traffic violations bureau in the county in which
the infraction was committed bv cash, money order, or cashier's check in the amount set
forth in the total colun~n of the attached schedule for the respective infraction or elect
to attend a driver improvement school.
My_person cited for the comnission of a traffic infra~ction who is not a resident of
or domiciled in the county Nhere the infraction took place or the State of Florida may
request an affidavit of defense form from the appropriate county traffic violation bureau_
for the purpose of filing a sworn written statement in defense of the citation, provided •
the offender post a cash appearance bond, money order or certified check in the violations
bureau in the county in which the infraction was comnitted which shall accompany request
for affidavit of defense forr.~ in the amount set forth in the bond column of the attached
schedule. .
A person who comnits a traffic infraction in his home county requiring a mandatory
hearing must appear for hearing as scheduled.
Any person who is required to appear or any person electing to appear in court shall
be determined to have waived his/her riqht to the civil penalty provisions of Section
~ 318.18 F.S. and upon determination an infraction has been comnitted the court may imoose
; a civil penalty not to exceed ~500 plus ~10 court costs or r.equire attendance at a driver
~ -
improvement school or bath.

Any person cited for the comnission of a traffic infraction where no hearing is
required and who elects to attend a driver improvement school in lieu of payment of penalty_
shall be directed by the citation issuing officer to contact the traffic violations bureau
in person or in writing within five working days ~n the county in which the infraction was
~ committed for directions on the school attendance. _
~ FOR LAW ENFORCEMENT OFFICERS:
l. Any oerson who willfully refuses to sign and accept citation or post
required bond shall be guilty of a second degree misdemeanor per 318.14(3)
