_THIS CAUSE came on for hearing upon t:~e motion of the ~
Defendants, BECKHAI~: & McALILEY. under Rule 1.380, Florida Rules
of Civil Procedure, and the Court having considered the deposition
of ROBERT M. MONTGOMERY, JR., the pleadings filed herein, and the
legal arguments of the parties, and it appearing to the Court as
follows:
The Plaintiff, JOHN B. SULLIVAN, M.D., filed suit against

BECKI~3AM & McALILEY, and others, alleging that said Defendants filed•
' a medical malpractice suit against DR. SULLIVAN on behalf of JOHN
i
~ Y. SKEENS, alleging that said medical malpractice suit was filed
i

~ without any probable cause, that the allegations of said suit were
i -
a
~ false and untrue, and that BECKHAM & McALILEY conspired with JOHN
s
~
~
~ Y. SKEENS to falsely file said medical malpractice suit. The witness,
~
~ ROBERT M. MONTGOMERY, JR., at his deposition, testified that he had
~
~ defended JOHN B. SULLIVAN in the medical malpractice suit filed
~
~ against him by JOHN Y. SKEEN. He further testified that his law
- file on this case was in his office and available for production.
~
~ That he had been employed in defending the SKEENS' case for a
~
~
~ period in excess of one year. That in the preparation of DB.
