HomeMy WebLinkAbout0125 payments of principle and/or interest under either or both the first and second mortgage the Mortgagor shall have the right to advance the funds necessary to cure such default and all funds so advanced by Mortgagor together with interest thereon at a rate of Eight and One-Half per cent (8~%) per annum shall be credited t against the next installments of interest and principle due under the note secured by this mortgage of even date. 7. The Mortgagor covenants that if and when requested by Mortgagee, it will execute such documents as Mortgagee or holder o~ this mortgage or the note secured hereby may require to evidence the unpaid balance owing to Mortgagee or said holder of this mortgage and said note. The failure of Mortgagor to furnish such statement wi~hin ten(10) days of request thereof shall be deemed acknowledge- ment by Mortgagor that to Mortgagor's best information and belief, no offsets or defenses exist against Mortgagor's indebtedness under the note secured hereby and that all regular installments of prin- ciple thereon ( and no other ) have been made. ! ? 8. ~~a~ the Mortgagor shall furnish to Mortgagee promptly $ ' copies of all notices of default which the holder of the first I r j and second mortgage shall give to Mortgagor, or which Mortgagor ' ; ~ shall give to or receive from tenants of the premises or any part I ~ or parts thereof based upon the occurance or alledged occurance, i ~ of any default of defaults in the performance of leases of space ` ~ tenants occupying any portion of the premises or all of the premises. ~ _ ~ ~ 9. Mortgagor shall have the right ot prepay the whole or any ~ part of the unpaid balance of indebtedness hereof at any time on ~ ~ Thirty (30) days notice without penalty.
