IN RE: Beginning at a concrete monument set on the '

South line of Tract 3 of the Gaines Estate ;
Subdivision; thence North 89 degrees 47 minutes '
West 389.1 feet to an iron pipe set on the ~
Easterly R/W line of the FEC Ry; thence Northerly
along the Easterly R/W line of the FEC Ry to i
a point on a line parallel to and fifty feet I
distant~from the South line of said Tract 3; ~
thence South 89 degrees 47 minutes East 446.1
feet, be the same more or less, to a point in i
the West R/W line of the Old Dixie Highway; !

thence continuing on same line a distance of
seventy-five (75) feet more or less to the
Indian River; thence Southerly following the
shore line of the Indian River to a point on
the South line of said Tract 3, said point -
beinq on a line parallel to and fifty (50)
feet distant from the above described North
line; thence North 89 degrees 47 minutes West
62 feet more or less to the point af beginning;
- said parcel of land being the South fifty feet
of Tract 3, Government Lot 2, Section 15, Town-
ship 37 South, Range 41 East, lying between the ~
Indian River and the FEC Ry; together with all ~
riparian rights thereunto belonging, or in any-
wise appertaining; subject to R/W of the present ~
State Road. ~
-BEFORE ME, the undersigned authority, this day personally appeared ;

JOSEPHINE BATTERMANN, who upon first being duly sworn did depose and

1. That she is one and the same person and Josephine Battermann, ~

one of the grantees in that certain warranty deed conveying the above- `
captioned property, and dated March 27, 1973, recorded in OR Book 354,
page 603 of the public records of Martin County, Florida.

2. That on the date of the aforementioned conveyance, she was ~
married to Ludwig Battermann and_that said marital relationship con- , ;
~ tinued without interruption until the date of the death of Ludwig
