and Loan Assocaition, a corporation organized and existinq
under the laws of the United States of America, which funds '
shall be credited by said institution to an interest-bearing,
6-year Certificate of Deposit.
2. The Certificate of Deposit referred to in Paragraph 1(b)
above shall be held by "Southern" for the use and benefit of
Loretta E. Wagner as to principal only, and for Nicholas U.
Wagner and Helen W. Wagner, his wife, as to interest. ~
3.."Southern" shall acknowledge in writing its receipt `
of funds from the registry oF this Court and shall acknowledge ,
that it.holds said funds pursuant to this Order.
4. Interest accruing annually to the Certificate account
established hereby shall be disbursed by check each year by
"Sauthern" to Nicholas U. Wagner and Helen W. Wagner, his wife,
in care of Fee, Parker & Fee, P. A., Post Office Box 1000, Fort
Pierce, Florida 33450.-
5. It shall be the responsibility of Loretta E. Wagner
to determine the annual amount of interest paid by "Southern"
to Wagner et ux, and to compute and pay within thirty {30) days
of "Southern's" payment whatever sum of money is calculated by
deducting the annual interest paid by "Southern" from the annual
sum due Wagner et ux, under their promissory note, to-wit, One _
Thousand ~ao Hundred and 00/100 ($1,200.00) Dollars. ;
6. At the end of the 6-year deposit period, "Southern"
shall continue to hold the principal sum received by it at
the highest available rate of interest until further directions
are received from this Court or until all interested parties,
to-wit: Loretta E. Wagner, Nicholas U. Wagner and Helen W.
Wagner, his wife, and John P. Gauc~iosi, Esquire, stipulate and ~
agree as to the disposition of said funds.
