and lawful money of the United States at the time of payment,
without d~~a~d, the annual rent of $1.00, in advance, on the first
day of each year during the term hereby granted, said annual rent
to commence on January 1, 1968. - ~ .
• 4, The Lessee will as expeditiously a~ posa~~le after the
execution and delivery hereof, commenc~ the deve~opment of said . °
lands as a pubtic recreational center, and build, develop and
construct two (2? practice fields for Little League baseball and _
at~all times will mainfiain said lands.for the se purposes and any ~
and all improvements of a~permanent nature placed upon,.buiit or
" constructed upon said land shall be and become the property of Lessor
upon #h~ expiration of the terms hereby granted, or sooner terminafiion
thereof. The~Lessee hereby agrees to develop said tract of land, it
. being expected and anticipated, however, that the development of said-
tract will require an extended period--of time with the Lessee agree-
ing to have one-half (1/2) of said entire tract developed within
one year f.rom date hereof. The Lessor hereby warrants free and
clear title to the lands and covenants that it has lawful authority
to Iease said lands, and will defend the title thereQf. Abstracts
of Title, brought up to date, will be furnished by Lessee. ~ -
5. It is understood and agreed: '

4 ,(a) That Lessor shall not in any manner whatsoever be

~ responsibie or Iiable for any cost or expense incurred by Lessee in -
~ any of the development and maintenance of-the desired tract, and any
and all such costs and expenses shall b~ the sole responsibility
and obligation of L'e~see; and -
(b) Lessee wi1Z not suffer or permit any mechanic's liens
or other liens for wor~c, labor, services or materials to be attached
~ to said premises or any part thereof, or to any building or improvement

~ construction thereon. The City shall assume and pay the entire present
