This cause came on for hearing upon Plaintiff's Motion for
Judgment on the Pleadings, and the Cour.t having considered the
complain~ for Declaratory Relief filed by the Fort Pierce Utilities
Authority and the answer thereto filed by the St. Lucie County-
li Fort Pierce Fire District, and having heard argument of counsel

~ Court finds, from the allegations of the Plaintiff and the admissions

~ ' The Plaintiff, FORT PIERCE UTILITIES AUTHORITY, is a separate
~ unit of the government of the City of Fort Pierce, Florida, created
~ and established by Ordinance No. F-399, subsequently enacted and

~ codified as Section 169 of the Charter of the City of Fort Pierce.

~ The Defendant, ST. LUCIE COUNTY - FORT PIERCE FIRE DISTRICT,
~ is a special taxing district created by Chapter 59-1806, Laws of
- Florida, as am~nded by Chapter 65-2191, Laws of. FLorida. The bounda-

~ ries of the above described district include all of the lands in
