Under the terms of Chapter 59-1806, Laws ot Flcc ida, as ~
amended by Chapter 75-2191, Laws of Florida, the Defendant is author-
i~ed to levy taxes on property within the district; the funds derived ~
trom such taxation to be used for, among other things, the construction, ~
maintenance, operation, and pu~chase of firefighting equipment.
Under the prov~~ions of Section 176 of the Charter of the City
of Fort Pierce, the Plaintiff-, FORT PIERCE UTILITIES AUTHORITY, is
authorized to operate City utilities, .to fix rates to be charged for
water and other utilities services sold and services rendered, and
to sell its products to public and private corporations and to other
consumers. Prior to June 29, 1972, at which time the Plaintiff,
FORT PIERCE UTILITIES AUTHORITY, came in~o being, the powers and

duties described in this paragraph were ves~d in the City of Fort
Pierce.
In recognition of the responsibility of the Defendant to
furnish fire protection to the residents of the District, and in
recognition of the fact that the City of Fort Pierce owned and operated
a water supply and distribution system equipped with pumping stations,

~ ~ transmission mains and fire hydrants suitable for use in f~refighting

~ activities, the Defendant and the City entered into a contract dated

; June 26, 1~67. Under the terms of this contract the Defendant agreed

! to make payments to the City of Fort Pierce for services which had

g been rendered prior,*o the date of the contract beginning with the

` fiscal year 1965-1966. in addition, and in consideration of the

' promise of the City to maintain in operational order all parts of
~

~ the water system, and to supply the Defendant with all water necessary
~

for firefighting purposes, the Defendant agreed to pay the City of

~ Fort Pierce the sum of Ten Thousand Dollars ($10,000.00) per year

; payable monthly commencing October 1, 1967, and continuing $hereafter
~
from year to year until such time as the contract may be terminated
.
