The undersigned petitioner alleges: ~
(1) Petitioner, FIRST UNION NATIONAL BANK OF NORTH
CAROLINA, has an interest in the above estate as a beneficiary ~
in the capacity as Trustee under a Trust Agreement. Petitioner's
address is 301 South Tryon St~reet, Charlotte, North Carolina.
(2) Decedent, WILLIE MAE MITCHLER, whose last known address
and place of domicile was City of Charlotte, County of
Mecklenburg, State of North Carolina, died on October 9, 1975
at Charlotte, North Carolina.
. (3) That so far as is known, the sole beneficiary of
this estate is the petitioner as Trustee.
(4) Venue of this proceeding is in this county because
certain real property located in this county was left by the
