In the event this contract is assigned without the written consent of the parties of the first part, then the full unpaid balance of the obligation referred to above sha11 be due and payable, at the option of the parties of the first part. ~ F AND the parties of the second part hereby further covenant and ` agree to pay promptly when due the principal and interest and other ; ~ sums of money provided for in this Agreement; to pay all and singular ~ the taxes, assessments, levies, liabilities, obligations, and encum- brances of every nature on said property; to permit, commit or suffer no waste, impairment or deterioration of said land or the improvements : s thereon at any time; to keep the buildings now or hereafter on said ; i land fully insured in a sum not less than the amount remaining from ~ time to time unpaid in a company or companies acceptable to the parties of the first part, the policy or policies to be held by, and payable to, said parties of the first part, and in.the event any sum of money becomes payable by virtue of such insurance, the parties of the first part shall have the right to receive and apply the same to the indebted- ; , ness hereby secured, accounting to the parties of the second part for ~ ' any surplus, to pay all costs, charged and expenses, including lawyer's ~ ~ ~ fees and title searches, reasonably incurred or paid by the parties of the firgt part because of the failure of the parties of the second part to promptly and fully comply with the agreements, stipulations, condi- tions and covenants of this Agreement; to perform, comply with and abide by each and every the agreements, stipulations, conditions and ? covenants set forth in this Agreement. In the-event the~parties of ; the second part fail to pay when due any tax, assessment, insurance ; ~ premium or other sum of money payable by virtue of this Agreement, i the parties of the first part may pay the same, without waiving or ; affecting the option to foreclose or any other right hereinder, and all suc h payments shall bear interest from date hereof at the highest lawful rate then allowed by the laws of the State of Florida.
