WHEREAS, the Condominium Associ.ation is the entity
responsible for the management, operation and maintenance of
the above-described Condominium, and has executed said
Membership Agreement for the benefit of itself and each of
its members, who become members in said Condominium Associa-
~ion automatically and as an incident to the ownership of an
apartment (Unit) in said Condominium; and
WHEREAS, ALISON is the owner and holder of a
certain mortgage encumbering the Condominium Land anci saici
Recreation Area and other lands, all being more particularly
described in that certain mortgage dated August 27, 1973,
and recorded in Official Records Book 218, at Page 246, of
the Public Records of St. Lucie County, Florida; and
WHEREAS, the Recreation Association has agreed to
assure the undisturbed non-exclusive use of said Recreation
Area described in Exhibit "B" to all owners of apartments in
OCEANA OCEANFRONT CONDOMINIUM ONE, and to the owners and
holders of individual mortgages on said apartments, and to
their respective grantees, successors and assigns subject to
the terms and conditions of said Membership Agreement as it

, WHEREAS, ALISON as the owner and holder of the
~ aforementioned mortgage lien on said-Recreation Area has ~
agreed to execute this Agreement for the purpose of assuring
the owners and mortgagees of apartments (Unit's) in said ~

Condominium, their respective grantees, successors and ~
. ~
assigns, of th~ir non-exclusive right to the undisturbed use ~
of said Recreation Areas. ~

; NOW, THERErORE, in consideration of the premises

~ herein contained and Ten Dollars ($10.Q0) and other valuable
~ consideration in hand paid by the Recreation Association to
~ ALISON, the receipt of which is hereby acknowledged, the
~ parties hereto agree as follows:
