PARKER, JR, , and FEE, PARKER & LLOYD, P.A. , wherein they seek to compel discovery as to Willis Flick an attorney in the law firm of Blackwell, Walker, Gray, Powers, Flick & Hoehl. D. , same being C~se No. 71-423 lately pending in the Circuit Court of St. Lucie County, f ~ Florida . The Plaintiff herein alleges that said medical malpractice filed i ~ ~ f ; against him was false and untrue and without probable cause. In said f E E Case No. 71-423 the Plaintiff, jOHN B. SULLIVAN , M. D, , was represented ~ : ~ ~ ~ and defended by attorney Willis Flick of the above referenced law firm who, ~ - ~ through such representation, compiled a file and accumulated facts and f ~ . ~ knowledge regarding the factual structure of that action. Attorney Flick 3 ~ i ` in said Case No. 71-423, concurrently and ancillarily represented Dr. ' Sullivan's medical malpractice insurance carrier, Commercial Union € ; Insurance Company which was not a named party in such case.
