functions to serve its members; however, the Homeowners Aesocia-
tion cannot assese more thatt $10.00 per unit per month qithout

directors coatrol the Homeowners Aaeociatioa, ao assesement in ~
excess of $10.00 can be made, even with approval of the member-
ship. ,
The Homeowaers Asaociatioa can assess, ia addition to -
the above $10.00, amounts aecessary to provide utility servicea ~
including, but not limited to, garbage collection aad sewage
disposal. .
The Homeowners Asaociation can further charge intereet {
y at 10~ per annum•, plus a late charge of $1.50 lor~late paymen~e ~
~ due hereunder or under paragr~ph 10, hereof.
~ The Homeownera Association shall have a lien on the
unit of any member who fails to pay any assessment when due ~or
the amount.of the assessoeRt and any late charge and interest. ~
Said lien shall attach immediately upon the payment aot being ~
made when due, but shall be inferior to any liens under para-
graph~l0 hereof. •
12. No trucks, or other commercial vehicles with a rated
load capacity of one (1) ton or more aha11 be permitted to be
parked in WINDMILL VILLAGS BY T~ SEA, UNIT 2, por a period of
more thaa four (4) hours, unless the same is present and necessary
in the actual~construction or repair of any building.
13. Al1 garbage and trash containers, oil tanks, water ~
~ pumps and tanks, and bottle gas taaks muat be underground or place
in walled-in areae in order that they will not be visible from
surroundiag properties. No unsightly atructure shall be permitted
for this-purpose, and all such str~uc~ures must be approved by the
Homeowners Association.
14. There is hereby reserved to the Grantor, its successora
and assigns, a utilitq easemeat over the rear 6 feet of the lot
being ccaveqed hereby. The rear of the lot shall be deemed the
portion of the lot furthest from the street line.
15. Grantee herein, by acceptance of this Deed, shall be-
I come a membar of Homeowners Association. Such membership shall
automatically gass to anq grantee, assigns, successor or heir
upon their~acquiring title to the property herein conveyed. ~
Reeignation as a member will not affect any obligatione by Grantee
~ under the provisioas of this Deed. !
16. Al1 leases, initially for a period o~ over one year, or ;
which extend over one year by renewal or tenancy at will o~ suffer '
ance, ehall require approval of Homeowners Association. If the ~
original lease is over one year, the approval shall be before the '
lease is eaecuted. IP the initial lease is less thaa one qear, ~
but continues as aforesaid, over one year, the approval ehall be
~ obtained within 30 days after the first year has eapired. The
Homeowners Aseociation approval will not be arbitrarily or un- ~
reasoaably Withheld. The Homewowners Asaociation vni.ll approve or
disapprove a lease within 30 daye of the time of receiving auch '
request, supported by such information as it may reasonably
require. If Homeoaners Association does not approve or disapprove
the application within that period of time, it shall be presumed
the application was approved.
1?. In case the graatee, their heirs, legal representatives,
succesaors or assigns, shall violate, or fail to carry out any or '
all of the stipulated conditions, proceedings to enforce complianc
