after hearing argument and bein~g duly advised in the premises, it is •

ORDERED, ADJUDGED and DECREED that the Motion To Strike from

! DEPARTMENT STORES, INC. and MARK McGEHEE, be and the same is hereby

k granted and the Court deletes by interlineation the following language
~ from Paragraph 39, Count V, of the Fifth Amended Complaint:

which to identify or know the name of the

. .or should have known. .
..or should have known. and it is further
ORDERED, ADJUDGED and DECREED that the Motion To Strike Ore
