the aum of Ten (~10.00) Dollare and other good and valuable oonsiderationa. the
partiea hereto agree as follows:
1. That in the event the Purchasers, their heira or asaigna shall build,
construct, or place a sewage treatment plant on the landa described in Exhibit "A"
attached hereto and by reference made a~part hereof or on other lands adjacent or

near ther~!~ for the purpose of providing sewage treatment facilities and service to
the lands deacribed in said Exhibit "A" , the Purchasers shall at their expense design
' said sewage treatment plant in such a manner that it may be expanded to a capacity
of not less than 100 ,000 gallons per day . The initial cost of oonstruction of the plant
as so designed to be expanded shall be at the sole expense of the Purchasers .
2. The Purchasera further agree to make available to the Seller, its
successors or assigns , that portion of the plant capacity or designed capacity which
is in excesa of the capacity actually needed for providing sewer treatment facilities
and services to the lands deacribed in Exhibit "h'' aa they may be finally developed
and improved. The Seller, its successors or assigns shall have the right and
privilege to expand the said sewer treatment facility and plant to a m~imum of
100,000 gallons per day and to utilize the excess capacity to provide sewage treatment
` facilities and services to lands now or hereafter owned by it, its successors or

~ assigns adjacent to or in the near vicinity of the lande described in said Exhibit "A" .

~ The cost of expanding said sewage treatment plant and facility from the designed

~ criteria needed for service to the landa described in Exhibit "A" to such expanded

capacity up to and including 100,000 gallons as may be deaired by the Seller, its
~ successors or assigne , shall be paid solely by the Seller, its succeasors or assigns .

~ 3. The Purchasers for themselves, their heirs and assigns, agree to
~ provide Seller, its successors or assigns , with such access and ~asements as may
~
~ be necessary to provide for the expansion and full and oomplete utilization of the
~

~ sewage treatement facilities and plant by the Seller, its successors and assigns.

~ 4. The Seller, its auccesaors and assigns, shall pay a pro-rata ahare
~
~ of the cost and expenses of operation of eaid sewage treatment facility and plant based
~
