prior to auch expaneion . Such payments shall b~ due only upon use of the facility by
Seller, ite auccesaora or assigns.
. 5. This Agreement ahall enure to and be for the bene5t of the heirs,
successors, peraonal repreaentatives or asaigns of the parties hereto. Upon aseignment
or transfer by Seller of its righte hereunder, the parties agree that Seller shall be
relieved of all reaponsibilities or obligations under this Agreement; provided, however,
this release of liability ahall not enure to the benefit of Seller's assigns .

Lucie County, Florida, and shall constitute a servitude upon the lands described ~
