That defendant, J~iES SPOSATO, JR.'S oral motion to amend his tnird party complaint filed in this action against JAMES L. BOUDET, is hereby granted and the first sentence of the second paragraph of said third party complaint is hereby amended to read as follows: "Third party plaintiff, JA,~IES SPOSATO, JR. and third party defendent, JAA~iES L. BOUDET, have entered into - an agreement, wherein each party has obligated him- self to pay one-half ~1/2) of any judgment awarded against either said party arising out of the l~w ~ suits filed by J~L;iES and Mt1RY TATE." 2. J~NES L. BOUDET'S motion to dismiss the third party : complaint filed by Jt~,~fES SPOSATO, JR., is withdrawn by stipula- tio~i of the parties and JEU~IES L.
