other good ausd valuable consideration, the receipt of which
is hereby acknowledged by Mortqaqee, the parties hereto, for
theniselves, their succeesors and asaiqas, hereby mutually
covenant and aqree as followa:
. l. That Condominium Parcel No. 113 of CAPSTAN I,
accordinq to Declaration of Condominium recorded in O.R.
Book 232 paqe 619 throuqh 711, of the public records of St.
Lucie Cour~ty, Florida be released and discharqed from the
lien of said mortgage and that Condominiwn Parcel No. 122 of
~ CAPSTAN I, accordinq to Declaration of Condominium recorded
: at O.R. eook 232 page 619 throuqh 711, public records of St.
: Lucie County, be substituted as security therefor.
~ ' 2. It is expreasly understood and.agreed that all
of the other terms and conditions of said mortqage and the
_ promissory note secured thereby shall remain in full force
: and effect and that nothinq shall impair any right or powers
which the Mortgagee may have under the mortqage and promissory
note for the recovery thereof in case of default.
3. Mortgagor expressly ratifies and confirms that
the indebtedness described above is a first mortgage lien on
Condominium Parcel No. 122 of CAPSTAN I upon the recordinq
of this agreement.~
4. The parties do hereby ratify and confirm said
mortqage and promissory note, and the Mortqagor expressly ~
agrees to perform the terms and conditions thereof.
