Pursuant to Florida Rule Of Civil Procedure 1.420(a),
the Plaintiffs herein elect to take and to enter a Vo2untary `
Dismissal With Prejudice as to Defendants, WILLIAI~i U. MOORE, JR.,
and BETTY MOORE, his Wife, in this cause upon the condition that
the First National Bank of Fort Pierce, Florida, fully perform
under the terms of an escrow agreement wherein CARL E. WAMMES and
PEARL WAMMES, his Wife, have authorized said Bank to withhold
$10,000.00 from the proceeds paid to CARL E. WAMMES and PEARL
WAMMES, upon closing and to hold said monies pending final
judgment or resolution of ",tigation by the Plaintiffs herein for
