The interest and principal of this note shall be paid as follows:

payment of thirty-nine/and no/100 ciollars ($39 , OCO. 00) due August 31 , 1977.

The aforesaid payments are to be applied first to interest at the rate aforesaid due ~

paid, and the balancs of each payment shall be applied to the reduction of the
. principal.
All payments of interest and principal are payable at the office of the payee in
the city above set forth, or at such other place as the holder may designate in
writing, in lawful money of the United States. If any of said payments of interest
and prlncipal ~ shall not be paid when due then the entire principal sum and accrued
intsrest shall b~come due and payable at once, at the option of the holder of this
note. ~

~ This note is to be construed and enforced according to the laws of the State of
Florida, and is secured by mortgage on real estate dated March 5 , 19 76.
If default be mads in the payment of any of said sums or interest or in the per-
~ formance of any agre~ments contained here , or in perfornhance of the terms of the
mortgage securing this note , then , at the option of the holder of the same , the prin-
cipal sum then remaining unpaid with accrued interest shall immediately become
due , payable and collectible without notice , time bsing of the essence of this con- ;
tract, and said principal sum and said accrued interest shall bear interest at max-
imum rate then allowed by law, from such tfine until paid. The holder is givgn '
and agreed to have other propsrty of each maker, guarantor and endorser in posses- ~
sion or control of the holder for any and various sums due hereunder, without
I~ requirement of notice .

Any language in said note or mortgage to the contrary notwithstanding , no inter-
~ est shall be charged or collected in excess of that allowed by Florida law, : nd in
~ the event of the acceleration of the mortgage, and the notes secured thereby, any
~
~ ~prepaid and unearned interest and poin[s in excess of a lawful rate of interee~ to
e the date of enforcement of payment shall thereupon be refunded to the MortS :~or
i automatically by the crediting of same against the sum then due, but such credit
= shall not cure or waive any default occasioning acceleration.

~ Each maker, guarantor and endorser waives presentment, protest, notice of -
s protest and notice of dishonor and agrees to all costs , incfuding a reasonable
attorney's fee and any attorr?ey's fees incuFred on appeal, whether suit be brought
or not, if counsel after maturity of this note or defauit hereunder or under said t
mortgage , be employed to callect this note or to prote st the security thereof .
