HomeMy WebLinkAbout0347 / : ~ o~ ~ ~ ~ ~ ' ~ ' ' 34~41:~ ~ ~ MINUTES OF THE REGULAR MEETING OF THE CITY COMMISSION OF THE CITY ~ OF FORT PIERCE, FLORIDA, HELD IN THE MUNICIPAL COURTROOM, 435 4 NORTH SEVENTH STREET, FORT PIERCE, FLORIDA, ON MONDAY, AUGUST 30, 1976, AT 7:30 P.M. Those present: Mayor Bryan, Commissioners Browning, Caynon, Leslie and Long; City Attorney Brennan, City Manager Jackson and City Clerk Lowry. Those absent: None, r Mayor Bryan called the meeting to order. Mayor Bryan gave the invocation Motion was made by Commissioner Leslie, seconded by Commissioner Caynon, and unanimously approved that the minutes of,.the regular meeting of August 23~, 1976, be approved. City Manager Jackson said the Commission received from the Planning Board a site plan for approval on Unit T~ao, High Point of Ft. Pierce.This requires permitting in an area that basically -is a private development where it is set out in the articles of the condominium that these facilities •~aill remain the property of the association. As a result we were trying to determine what effect the site plan approval of the City Commission would have in relationship to the time in the future when there was a desire for High Point to attempt to requPSt these facilities be made public. There is apparently no simple solution to accomplish what the Commission is interested in and that is to receive a commitm~nt that at anytime in the future it will be clearer that these facilities are public and that they are not to be considered a part of the general domain of the government and under our responsibility as far as mai.ntenance is conc~rned. At this poinf we have a suggestion to go ahead and review the site plan. It has received the approval of the Bui?ding DepartmPnt and the Engineering Department. We need to put on the face of the approval the various conditions which we have outlined, that this is a private development, I that these facilit~es are not necessa~`ily built to the ~pecifications contained in the subdivision ordinance or other ordinances as far as public improvements are concerned and if possible put the document in shape so it can be recorded. Mayor Bryan asked if we had received a letter from High Point, and City Manager Jackson stated we had receiv~d a letter that is basically in the form that was set out by Mr. Jefferson in Mr. Brennan's office. The letter is as follows: August 30 , 19 76 - - - City Commission~ City of Fort Pierce, Florida RE: High Point of Fort Pierce, Section II APpRR:1€RS • ~ " ` Q Q D V - 0 ~ Gentlemen: ~ p~ ~ 6 In order to c~arify any confusion in the submission of the site plan for Section II of High Point, this letter supercedes all previous letters on High Point, Section II. The improverr,ents including roads in Section II do not conform to the City of Fort Pierce specifications for subdivisions, such improve:lents being private property and will be completely maintained by the incorp~rated association of home owners. It is not the intent of the developer to dedicate or request eity acceptance of maintaining the High Point faeilities. If I can be of any further assistance to you or provide other information for Section II permitting approval, please advise.
