City Manager Jackson said receiving this letter and putting
these cor.iments on the site plan is the legal advice we're
receiving to do which will get us in as good a position as
we can. The other alternative is to require the development
or developer to conform to City standards as far as streets, t
sidewalks, curbs and gutters are concerned.
City Attorney Bi~ennan said by going the route of record~ng the
site plan with the stipulatior~s on it, it gives notice ana tne
only way we can give notice to anybody that buys any property
in Section II. -
Mayor Bryan asked if it would be possible to record the ori~inal ~
of this letter as an attachnent to tne site plan and City ~
Attorney Brennan stated it would be.
City Manager Jackson said we were able to determine that a
person who is a prospective condominium buyer does not receive
one of these two or three page offering statements with everything
set out. ~

Manager Jac;cson said Mr.~Jefferson had sugoested if the developer
agreed to do something like this and put this on file with the
City it would be helpful, but there is nothing that advises
the prosgective buyer unless his l~wyer happens to discuss that
with him. _
Mayor Bryan asked what r~~otion would be envis~oned as`being
~DDT'O~ ri.ate. City Attorney Brenr:an said a;notion to approve
the site plan with the restrictzons and tne stipulation that
it's not ~aing to be to our speciiications and we won't be
~ takin~; over the mazntenance of the roads. The site plan is
to be r~~~rded with a letter attached.

~ l,esli~, and unanir~~ously approved to lift the consider~tion
of a.~proval of Site Plan relative to Hign Point of Fort Pierce
~ Phase II from the table.
Motion was made by CoT~**~issioner Leslie, s~c~:~~ed by Cor~L;iissioner
Erowr,ing and unanirnously aFproved that the si~e plan be approved
subject to the agreer:?ent with tne developer of High Point that
they are not going to construct the r.~ads or the drainage system
in accordance with City specifications and the City will not
be responsible for the maintenance of either the road system or
the ~-ra:nage system at any present time or any futu^e time, and
tnat responsibility will eventually go from the developer
to t~e ~~c~ividual owners of the condominiums.
Mr. Sche?Ihase said he wanted to thank the City Eng~n~ering
Der.rr~:r.-_.~t for what they've done relative to High Point. He
wishe~ to ~~~ke it clear tnat neve^ at any time had he ad~ressed
the Cor~~:~ission on this subject that he was opposed ~o the
developr.:ent of Section II even though he'd be accused by one
of the members of the developer.
