FOR VALUE RECEIVED, the undersigned, ~ointly and severally, promise to
pay to the order of ALBERT J. DiVAGNO and ARLINE R. DiVAGNO. his wife,
at P. 0. Box 611, Banner EIk, North Carolina 28604, the principal sum,
inc Iuding one ye ar' s interes t, of FORTY THOUSAND FIVE HUNDRED NINETY-TWiO
and 12/100's DOLLARS with interest at the rate of seven per cent per
annum from SEPTEMBER 29, 1977 until paid in inatallmenta as follows:

167 equal monthly payments of $320.00 each, commencing October 29,
1977 and a like sumn on the corresponding day of each like succeeding
period thereafter until the 168th payment at which time the remaining
principal and interest shall be due and paid in one BALIAON PAYMENT.
Each installment shall first be applied in payment o nter~~t ar?
then on the unpaid balance of the principal sum.
The maker reserves the right of prepayment at any time, in whole or
in part, without penalty.
The makers agree that in the event the property securing this note is
solc~ t~y ~hem or in the event that they convey equitable or legal •
interest which they may own in the premises to a thirci party, the~i i~t
that event the entire unpaid balance of this note shall be due and
payable in full and that the second mortgage and this note shall not
be assigned to or assumed by any third party.
If any installment be not promptly paid within 10 days next after the
same becomes due, then, at the option of ~the holder hereof, the full
amount remaining due upon this note shall thereupon become due and pay-
able at once, together with all other indebtedness stipulated in thie
note and in the mortgage given to secure the same.
The makers and endorsers of this note further agree to waive notice
of non-payment, protest and demand for payment, and in case auit shall
be brought for the collection hereof or the same shall be collected
upon demand of an attorney, to ~ay all expenses of such collectian.
