Borrower shall promptl~• pa~~, w•hen due, al! asscssments impascd by the Owners Association or other governing hociy of thc Condaminium Praject (hcrein "Owners Association") pursuant ro the provisions of the de~laration, by-la~vs, cocle of regulations or other constituent document of the Condominium Projeet. B. Hazard Insurance. So long as the Owners Associatic~n maintains a"master" or "blanket" policy on the Condominium Project ~4hich pravides insurance co~~erag~ against fire, hazards included within the term "extended co~~~ra~c;' and such other hazards as Lender ma~~ require, and in such amounts and for such periods as Lender may require, th~n: (i) l.ender waives the provision in Uniform Co~•enant 2 for the monthly pa~~ment to Lender of one-twelfth of th~ premium i~stallments for hazard insurancc on the Propert~•; (ii) Qorrawer's obligatic~~ under Uniform Covenant 5 to maintain hazard insurance coverage on the Pm~rt~- it deemed satisfied; and (iii) the pmvisions in Uniform C'o~~enant 5 regarding appiication c~f haza~d insurar~ce pr~tecds shall be superseded b~~ an~• provisions o[ the declaration, b~•-laws, cocle of reeulations ar other constituent doeument of the Coadominium Project or of applicable la~c to the extent necessar~• to avoid a conflict bctween such provisions and the provisions of Uniform Co~~enant 5. For an~• period of time during w•hich such hazard insurance coverage is not maintained, the immrdiatcly preceding sentence sh:~ll be deemed ta ha~~e no force or eftect. Borrower shall give Lend;r prompi notice of any lapse in such hazard insurance co~~erage. ln the cvcnt of a distribution of hazard insurance proceeds in lieu of restoration or repair following a loss to th: Propert~~, ~vhether to the unit or to common elements, any such proceeds payabte to Borrower are hereby assigned and shall be p~+id to Le~~der for application to the sums secured b~~ the securitp instrument, with the excess, if any, paid to Borrow~r. - C. Lender's Prior Consent. l3orro~ver shall not, except after notice to Lender and with Lender's prior written f consent. partition or subdivide the Property or consent to: - ~ (i) the abar.danment or termination of the Condominium Project, except for abandonment or termination ~ pro~~ided by law in the case of s~bstantia! destructian b~• fire or other casualty or in the case of a taking by condemnation or eminent domain; (ii) an~ material amendment to the dcclaration, by-laws or code of regulatio~s of the Owners Association, or equivalent constituent document of the Condominium Project, including, but not limited to, any amendment which would change the percentage interests of the unit o~vners in the Condominium Project; or (iii) the effectuation of any decision by the Owners Association to terminate professional management and assume self-management of the Condominium Project_ ~ D.
