It any Instalment Payment shall not be paid when due, then the entire principal aum and accrued interest here- under shall become due and payable at once or thernafter, at the option of the holder o[ this Note. The Payee may. at its option, collect a late charge not to e:ceed two centa for each one dollar of each Inatalment Payment not paid when due to reimburse the Payee for expenses of servicing delinquent Instalment Paymenta. Failure to exetrise th~e options shall not constitute a wai~er of the right to exemise the same in the event of any suk~aequent defaull It is further agreed that the Maker and each endorser, eurety, guarantor, jointly and severally, shall pay all costs ot collection ot this Note, including a reasonable attorney's tee, on failure to pay any Instalment Payment or any accrued interest due hereunder on the due date thereof. This Note and all sums due hereunder ahall bear intereat at the highest law~ful rate ot interest per annum in the State of Florida from the date when the principal and accrued intereet under ~ this hTote shali be due and payable. The total interest payable hereunder shal! not in any one year e:ceed the higheat I lawful rate of interest in the State of Ftorida. This tiote ~s secured by a 1Nortgage, dated the date hereof, of property eituated in the State of Florida. The Maker agrees that it shaU be bound by any agreement eztending, the time or modifying the above term_+ of payment, made by the Payee and the owner or ovmers ot the property af[ected by said MortRage, whether with or with- out notice to the hlaker, and the Maker shall continue liable to pay the amount due heceunder, but with intereat at a mte no greater than ihe Interest Rate, accordinR to the terms of any auch agreement o[ extension or modification. The unpaid balance ot the Prinripal Amount, plus accrued intere~t shall become due and payable at the option of the Payee under the happening of an event by which said balance shall or maq become due and payable under lhe tetms of ~~id Mortgage. ~ This Note may not be changed orally, but only by an agreement in writing, aigned by the party against whom en- ' fomement of any waiver, chanRe, modi[ication or discharge is sought.
