8. That while the plaintiffs were so seized of the said property, .
and on or about the early part of January, 1976, the defendant, MARTIN

LEIBOWITZ, falsel_y and fraudulentty represented to the plaintiffs, that if ~ ,
the plaintiffs would convey the a~oresaid lots into the names of the defendants,

the plaintiff, ALBERT ABATO to construct and erect upon the three (3) ~
aforesaid lots, one-family dwellings, when completed, were to be resold, '
' and the profits thereof, if any, to be shared by the said plaintiff, and the said .
defendant, and that the said defendant, MARTIN LEIBOWiTZ, further falsely '
and fraudulentty represented ~ to the plaintiffs that he woutd undertake to '

furnish atl the necessary financing for the erection of the said three (3)
