CASE NO. 73-770-CA
is hereby susp€nded upon the condition that the Husband, EDWARD F. _
NSWBSR~GER, SR., shall pay to the Wife, J$AN H. NBWBER~GER, the snm of
$450.00 within thirty (30) days from the date of thia Order.
4. Upon failure-of the Husband, EDWARD F. NEWBERGER, SR., to
. make said payment of $450.00 within thirty (30) days from the date of
this Order then a member of the iaw ~irm of Flilles, Bittan & i~iiies
or the Wife, JEAN H. NEWB$R+GBR, may file with this Court an affidavit
to that effect and a committaent order will be issued without further
notice to the Husband, EDWARD F. NEWBERGER, SR.
S. The Court finds and determines that the Husband, EDWARD
F. NSWBSRGER, SR., had the financial ability to pay the back periodic
alimony payments but has willfully refused to do so when said periodic
payments became payable, therefore it is ordered that the Husband is
not entitled to have his claim for modification considered and the

I said cause is hereby stayed.
