~ This cause came on for hearing on the motion of the j T
' ~ Defendant, JOHN F. NIXON, to amend and supplement his pleadings }
~ ~ and add additional parties. The Court has considered this motionf
- i
as_well as the oral motion of the Defendant, John F. Nixon, at '
~ ~ the hearing to substitute for the Third-Party Complaint that was ;
~
~ attached to his motion a revised pleading which, among other
things, will add S& P Company (formerly Shamrock Vil~age, Ltd.)
~ ~
~ ~

~ ` as an additional third-party defendant and incorporate addi- ; ;
~ ' ~
~ . tional allegations authorizing substituted service of process on E
i ~
~ i
~ the third-party defendants, they being non-residents of Florida
~ and having no resident agents or officers in Florida. At the
~
j hearing, no objection was made to the motion or substitution. It`
appears to the Court that tt?e proposed amended and supplemental
pleadings are appropriate and that the third-party defendants may ;
be liable to the Defendant, John F. Nixon, for all or part of the -
!
~ - claim asserted by the plaintiff as well as for damages in excess ~
i of $2,500 that arise out of the same transaction or occurrence ~
~ that is the subject matter of the original action. And the Court,
j .
being otherwise advised, upon consideration thereof, it is
ORDERED as follows:
(1) That the motion by the Defendant, John F. Nixon, to
amend and supplement his pleadings and add additional parties, as
well as his oral-motion to substitute a revised third-party com-
plaint for the third-party complaint that was attached to his
motion, are hereby granted; '
