THIS CAUSE having come on for hearing the 28th day of

~ having heard argument of counsel, and finding that as to the De-

~ fendant JAMES L. BOUDET'S Motion for Summary Judgment as to the

claim asserted against him by the Plaintiffs herein, that there

! exist no material~issue of fact, either framed by the allegations

of the pleading or by the discovery now before the Court, par-
~ ticularly as to a showing of personal involvement and actual malice
~ on the part of JAMES L. BOUDET, and being otherwise fully advised
~

~ in the premises, it is thereupon

~ ORDERED AND ADJUDGED as follows:
1. Defendant JAMES L. BOUDET'S Motion for Summary Judg-
ment is granted as it pertains to the claim asserted against JAMES
L. BOUDET by the Plaintiffs herein, and the Defendant JAMES L.
BOUDET'S Motion for Summary Judgment as to the claim asserted by
the Co-Defendant, JAMES SPOSATO, is denied.
