Motion to Amend its Reply, it is ordered and adjudged:
plaintiff is hereby qiven leave to amend i'ts reply by
adding the followinq: ~
l. (f) Defendant, HEALTHCO, ~NC., was paid _
for equipment and supplies sold to de~endetnt, MARR H.
HILI.MAI~t, from the proceeds o~ the loan m~de by p2aintiff
to ttie said MARK H. HILLMAN, and defendant, HFALTHCO,
INC., lias not returned nor has it eVer offered to
return any portion of said loan proceeds.
~ ~q) Defendant, HEALTHCO, INC., accepted
proceeds from the loan made by plainti~~ to de~endant,
MARK H. HILLM~i,N, and retained said loan proceeds after
. it had knowledge that defendant, DSNNIS BX. MHYRE, had
endorsed subject proiaissory note on heh$l~ of defendant,
HEA.LT8C0, INC., and sa#.d defendant thereby ratified and
approved such endorsement.
