HomeMy WebLinkAbout0171 In the event 5196 or more of the property awners shall agree to construction of paved roads~in ST. LUCIE PINES by the County of St. Lucie, State of Florida, by Special Assessment, all property awners therein shall then be deemed to agree to such Special Assessment in compliance with the law of Special Assessment and shall be leqally bound thereby and shall pay all assessments legally made therefor. III.~ Duration, Amendment and Enforcement of Protective - Covenants and Miscellaneous ~l. The protective covenants and restrictions, contained in this Declaration of Covenants and Restrictions shall be construed as covenants running with the land and shall inure to the benefit of and be enforceable by the Developer, the Association, which shall be deemed the agent for all of its members for such purpose of adminis- tering condominium properties upon the Property, and by the awner at any time of any portion of the Property, by actions at law or by suits in equity. The failure of any person or orqanization to enforce any covenant herein cohtained shall in no event be deemed a waiver by ' that or any other person or organization of its rights to thereafter i ~ enforce the same, nor shall any liability attach to the Developer or ~ any other person or organization for failure to enforce such covenants. € 2. Upon violation of any protective covenant or restric- tion herein contained, the Association and/or the Developer, in addition to all other remedies, may seek an order from a court of competent jurisdiction permitting it to enter upon the gortion of the Property upon or as to which such violation exists, and summarily to ~ • abate or remove the same, using such force as may be reasonably nece- ~ - ~ ssary, at the expense of the owner thereof, and neither the person ~ ~ entering nor the organization directing the entry shall be cleemed ~ ~ liable for any manner of trespass for such action.
