SETTLEMENT AGREEMENT ~9~~'

THIS AGREEMENT made and entered~into this`~day of
~ ~ ~ 1977. by and between SUSAN NARWELL ADGER, here- ~
~ f
inafter~referred to as the "Wife"~ and THOMAS MORRIS ADGER, hereinafter
referred.to as the "Husband."
WHEREAS. the parties were lawfully married to each other on
the bth day of April. 1968. in Houston, Texas; and
WHEREAS. three children were born of this marriage, to wit:

AMANDA KEATHLEY ADGER, born 31 July, 1971, age 5: EMILY HARWELL ADGER, i

born 15 June, 1973, age 3: and TIMOTHY ~LFORD ADGER, born 5 July, ~
1975, age 1, and
WHEREAS~ differences have arisen between the Husband and Wife
which are impossible of reconciliation, and
WHEREAS, the parties separated on or about September 18~ 1975, ~

and have since that time lived separate and apart from each.other;and ~

~ WHEREAS, the parties mutually desire to settle, ad.just and
compromise all custodial, financial and property rights between them
and to reach an agreement to that end, so that no difficulties may ;
arise hereafter with respect to such matters; and
WEIEREAS. each of the parties has received independent legal
.
~ advice as to the rights and obligations set forth in this Agreement, i

WHEREAS, each of the parties believes this Agreement is a, ~

just and reasonable, and assents freely and voluntarily to its terms. ~
NOW, THEREFORE, in consideration of the mutual covenants and
conditions contained herein, and other good and valuable considerations,
it is mutually covenanted and agreed between Husband and Wife as
follows: ~
1. Right to Live Separate-and Apart ~
~ At all t3.mes hereaf.ter, Husband and Wife agree that they shall
~ be entitled to live separate and apart from each other, and each
party shall hereafter be entirely free from the control of the other
