MOTION FOR AMENDED ORDER OF
SUMMARY ADMINISTRATION DZSTRIBUTION ~
The Movants, ARCH A. PUCKETT and KATHERINE BELLE PUCKETT
MARTIN, respectfully allege unto the Court as follows: '
1. Movants have previously filed with this Court their
Petition for Summary~Administration in the above decedent's
estate, said petition dated February 4, 1977.
2. Movants re-allege and re-aver all of the allegations
contained in Paragraphs 1, 2, 3, 4 and 5 of their prior petition.
- 3. Movants allege that the allegations contained in

Paragraph 6 of their prior petition with respect to the distribu- ~
tive share to which each was entitled as surviving spouse and
daughter, respectively, of the decedent, were in error, said
allegations being predicated upon Florida's substantive law of
~ intestate descent and distribution as set forth in F.S. §§732.102
i ~
and 732.103, which became effective January 1, 1976. ~
4. Movants allege that the decedent, Susan Belle Puckett, ~
~
died on July 21, 1973, and that their substantive rights in said
decedent's estatE vested on that date, and should therefore have
been determined based upon the Florida substantive Iaw of intestate ~
descent and distribution as set forth in former F.S. ~731.23.
5. Movants allege that this Court's order of summary
administration distribution should be amended to reflect their ~

entitlement to distribution in the following shares: ~

(a) To Arch A. Puckett, as surviving spouse, an
~ undivided one-half interest.

(b) To Katherine Belle Puckett Martin, as
surviving daughter, an undivided one-half interest. ~
